01Acceptance of Terms

These Terms of Service ("Terms") form a binding contract between you and KyTech ("KyTech", "we", "us") governing your use of the KyTech loader software, license keys, account panel, support services, and any related web properties (collectively, the "Services"). By creating an account, activating a license key, or launching the loader, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Services.

02Minimum Age

You must be at least 18 years of age to create an account or use the Services. By creating an account you represent that you meet this age requirement. If we learn that a user is under 18, the account will be closed and any purchases refunded per our refund policy. Consistent with the U.S. Children's Online Privacy Protection Act ("COPPA"), we do not knowingly collect personal information from children under 13; any such data discovered will be deleted on discovery.

03Your Account

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorised use. Accounts are personal and non-transferable.

04License Grant

Subject to your compliance with these Terms and payment of applicable fees, KyTech grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the loader software on device(s) you own or lawfully control, solely for the term of your subscription or license key. All rights not expressly granted are reserved by KyTech.

05Acceptable Use

You agree not to:

• Resell, redistribute, sublicense, lease, or transfer your license key or loader software to any third party;
• Reverse-engineer, deobfuscate, disassemble, decompile, or otherwise attempt to derive the source of the loader or any delivered payloads, except where such right cannot be lawfully restricted (e.g. EU Directive 2009/24/EC Art. 6 interoperability), in which case you must notify us first at [email protected];
• Re-obfuscate, re-package, rebrand, or publicly distribute the loader or any component thereof;
• Bypass, disable, or interfere with the anti-tamper subsystem, licence verification, HWID binding, version-check, or any other technical protection mechanism;
• Use the loader on a device you do not own or lawfully control, or on hardware belonging to your employer without their written permission;
• Use the Services in a manner that violates the terms of service of any third-party game or platform in a way that transfers legal liability to KyTech;
• Automate account creation, brute-force license activation, scrape the account panel, or otherwise abuse the API; or
• Use the Services in violation of any applicable law, regulation, or the rights of any third party.

06Anti-Tamper Monitoring

The loader software includes an anti-tamper subsystem that detects the presence of debuggers, disassemblers, memory-editing tools, packet-inspection tools, and specific VPN client software on your device at the moment you launch the loader. This detection runs client-side and only transmits data to KyTech when a signature match occurs.

When a match occurs, the loader transmits an evidence record to our servers. The record includes:

1. the specific detection reason code and severity tier;
2. a device identifier ("HWID") computed as a SHA-256 hash of your BIOS UUID, MAC address, and hostname;
3. system-configuration metadata (operating-system version and build, hostname, Windows account name, locale, timezone, uptime, PowerShell version, domain membership);
4. network configuration (private IPv4 / IPv6 addresses, MAC addresses of active adapters, the full network-adapter descriptor list); and
5. the list of running process names on the device at that moment (names only, command lines and file paths are not transmitted).

Our servers additionally record the public IP address of the connection, the coarse geographic location derived from that IP (country, city, ASN, CDN edge datacenter), and the browser User-Agent.

Full disclosure of every collected field, retention windows, and the legal basis for each purpose is set out in our Privacy Policy. Anti-tamper telemetry is retained per the retention table therein.

You may request review of a ban by contacting [email protected] with your Incident ID. Overturns are at KyTech's discretion. A soft-tier overturn suppresses re-banning for the same reason on the same HWID for 30 days; a hard-tier overturn grants exactly one subsequent successful launch before re-scanning resumes.

07HWID Ban Policy

HWID bans are per-device and non-transferable. A ban travels with the hardware, not with the account. Deleting your account does not lift an active ban, and creating a new account on the same device does not evade one. Grounds for issuance are limited to the signature set documented in our anti-tamper subsystem (see Privacy Policy §2). Bans are:

• Soft-tier. Informational; typically triggered by network-analysis tools or specific VPN clients. Overturnable via Support with a brief explanation.
• Hard-tier. Strong indicator of reverse-engineering activity (debugger, memory editor, kernel-debug hardware). Overturnable via Support with substantive explanation; some categories are reviewed by senior staff before release.

Appeals. Email [email protected] with your Incident ID. We aim to respond within 5 business days. Ban reversals are recorded in your account audit history. A user with multiple hard-tier bans reversed within 30 days may be flagged for enhanced review of future incidents.

08Billing, Renewals & Refunds

Fees are quoted in the currency shown at checkout and are non-refundable except as required by law or as expressly stated in our refund policy. Subscription plans renew automatically at the end of each billing period unless cancelled in the account panel at least 24 hours prior to renewal. You are responsible for taxes assessed by your jurisdiction. Payment processing is performed by Stripe and NOWPayments; their respective terms and privacy notices apply to that processing.

09Data Retention

KyTech retains the personal data associated with your account, purchases, service usage, and any anti-tamper incidents in accordance with the retention windows set out in the Privacy Policy §5. Deletion, portability, and access requests may be submitted via the self-service form at /dsar or by email to [email protected].

10Intellectual Property

The loader software, source code, obfuscation layers, cheats, artwork, trademarks, and any other component of the Services are the exclusive property of KyTech or its licensors and are protected by copyright, trademark, and other intellectual-property laws. No title or ownership is transferred to you under these Terms, only the limited licence set out in §4. Feedback you provide may be used by KyTech without compensation or attribution.

11Disclaimer of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYTECH DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KYTECH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY GAME COMPATIBILITY WILL BE MAINTAINED FOLLOWING A GAME OR PLATFORM UPDATE.

12Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. KYTECH'S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID KYTECH IN THE TWELVE MONTHS PRECEDING THE CLAIM AND (B) FIFTY U.S. DOLLARS.

Nothing in these Terms limits liability that cannot be limited by applicable law (e.g. liability for gross negligence, wilful misconduct, or personal injury caused by KyTech).

13Indemnification

You agree to defend, indemnify, and hold harmless KyTech and its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorneys' fees) arising from (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any intellectual-property or privacy right of any third party; or (iv) any claim that your use of the Services caused damage to a third party.

14Termination

Either party may terminate the account at any time. KyTech may suspend or terminate your account immediately for a material breach of these Terms, for suspected fraud, or as required by law. On termination of your account, whether by you or by KyTech:

• Account credentials and personal profile are deleted within 90 days;
• Purchase and payment records are retained for 7 years per applicable tax law;
• Any active HWID ban remains in force per its own retention window (Privacy Policy §5);
• Session logs, tripwire raw events, and telemetry are pruned per their own retention windows; and
• Any residual data retained under legitimate-interest or legal-obligation carve-outs (e.g. HWID hash for anti-fraud, audit log for regulator retention) is preserved with a data-minimisation posture. No email, no license key, no personal identifiers.

Sections that by their nature should survive termination (Intellectual Property, Disclaimer of Warranty, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, Miscellaneous) survive termination.

15Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section deprives you of the mandatory protections of the consumer-protection laws of the jurisdiction in which you are habitually resident.

16Dispute Resolution & Arbitration

Informal resolution. Before filing a formal dispute, you agree to attempt to resolve the dispute informally by contacting [email protected]. We will attempt to resolve the dispute informally within 60 days.

Binding arbitration. Except for disputes that qualify for small-claims court, and except where prohibited by law, any dispute arising out of or relating to these Terms or the Services shall be finally settled by binding individual arbitration administered under the rules of a recognised arbitral institution (such as JAMS, AAA, or an equivalent institution in the State of Florida, United States). The seat of arbitration shall be the State of Florida, United States. The language of the arbitration shall be English. Judgment on the award may be entered in any court having jurisdiction.

Class-action waiver. You and KyTech agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Severability. If the class-action waiver is held unenforceable in a particular case, that particular claim shall be severed from arbitration and litigated in court, while the remainder of this arbitration agreement remains in force. If any other portion of this Section 16 is held invalid or unenforceable, the remaining portions shall continue in full force and effect.

Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.

Consumers resident in the EU, UK, or other jurisdictions where pre-dispute arbitration clauses are unenforceable retain the right to bring proceedings in their local courts and are not bound by this section to the extent local law so provides.

17Changes to These Terms

We may update these Terms from time to time. Material changes will be notified at least 30 days in advance by email to your account address and by an in-panel banner. Immaterial changes take effect on posting and are reflected in the version number at the top of this page. Historical versions are archived at /terms/versions. Continued use of the Services after the effective date of a change constitutes acceptance.

18Miscellaneous

Entire agreement. These Terms and the documents they incorporate by reference constitute the entire agreement between you and KyTech regarding the Services and supersede all prior agreements.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

No waiver. KyTech's failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without KyTech's prior written consent. KyTech may assign these Terms without restriction.

Force majeure. Neither party shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control.
